AZDHS Change a Child’s Name on a Birth Certificate

** Changing the name of the registrant when the registrant already has a name on the birth certificate
** Arizona Revised Statute A.R.S. § 36-337 and Arizona Administrative Code A.A.C. R9-19-118 permits the change of the registrant’s name within the first year following birth.

** After one year these laws require a court order to make this change.

** A.A.C. R9-19-120 also requires a court order to change the registrant’s name on a delayed birth certificate.


** A.R.S. § 36-323 and A.A.C. R9-19-116 restricts the list of people who may request corrections or amendments to birth certificates.
** Only the registrant (if the registrant is 18 years of age or older), the parent or legal guardian (if the registrant is under the age of 18) may submit a request to change the registrant’s name.

 

Birth to Three (3) Months After Birth :
The following is required to amend the registrant’s name :
** The Affidavit to Correct or Amend a Birth Certificate must be completed and the form must be signed in the presence of a notary.
** A completed and signed Arizona Vital Records Request for Copy of Birth Certificate application.

** A copy of the front and back of your valid government issued picture identification which bears your signature or have your signature notarized on the Arizona Vital Records Request for Copy of Birth Certificate Application.

** The amendment fee. Please reference the fee schedule for the appropriate fee. Acceptable payment mothids are cashier’s checks, money orders, Visa, or Mastercard.
** Please Do Not Send Cash.
** Cashier’s checks and money orders must be for the exact amount and made payable to the Office of Vital Records.
** If you pay by credit/debit card, you must include the full card number and expiration date on your application.

Three (3) Months to Less Than One (1) Year After Birth :
** The Affidavit to Correct or Amend a Birth Certificate must be completed and the form must be signed in the presence of a notary.
** At least one independent factual document established within the first six months after the registrant’s birth that support the changes requested on the affidavit.
** A completed and signed Arizona Vital Records Request for Copy of Birth Certificate.

** A copy of the front and back of your valid government issued picture identification which bears your signature or have your signature notarized on the Arizona Vital Records Request for Copy of Birth Certificate Application.

** The amendment fee. Please reference the fee schedulefor the appropriate fee.

One (1) Year or More After Birth :
** A certified, court ordered name change is required to change the registrant’s name one year or more after the registrant’s birth.

The following must be submitted to initiate the change to the birth record :
** The court ordered name change that has been certified by the court where the proceeding was finalized.

** A completed Affidavit to Correct or Amend a Birth Certificate form may be required (optional) if the court order referenced in #1 above does not clearly specify the name(s) that should be listed in the first, middle, last and suffix fields on the birth certificate.

** This form must be signed in the presence of a notary.

** A completed and signed Arizona Vital Records Request for Copy of Birth Certificate.

** A copy of the front and back of your valid government issued picture identification which bears your signature or have your signature notarized on the Arizona Vital Records Request for Copy of Birth Certificate Application.

** The amendment fee. Please reference the fee schedule for the appropriate fee.
