EORI Registration & Identification number :

The EORI number (Economic Operators’ Registration and Identification number) is an operator identification number that is valid throughout the European Union and replaces the German customs number.

Since Regulation (EC) No 312/2009 amending provisions for the implementation of the Customs Code came into force on 1 July 2009, this number is a prerequisite for customs clearance in the European Union.

Using the EORI number:
The EORI number is a number issued by the competent authorities in the European Union that allows the Customs authorities to identify economic operators and, where necessary, other persons.

The legal basis for the number is Article 4k(1) of Commission Regulation (EEC) No 2454/93 of 2 July 1993 laying down provisions for the implementation of Council Regulation (EEC) No 2913/92 establishing the Community Customs Code.

Economic operators are persons who, as part of their business activities, are involved in activities that come under customs law. Persons living in the European Union must request an EORI number from the member state in which they are living (Article 4l Regulation (EEC) No 2454/93). Third-country operators must be registered by the member state in which they first wish to act as a declarant and/or representative or as principal.

Economic operators are obliged to quote their EORI number. Persons other than economic operators (private individuals) are generally not required to quote an EORI number, not even where they are immediately represented by a service provider (for example, by the provider of a post or express service).

Private persons are required to quote an EORI number if they are exporting goods for which an authorisation is required.

In customs declarations, the EORI numbers of the following persons must be quoted:
** the declarant and his representative,
** the consignee when importing,
** the consignor/exporter and sub-contractor when dispatching/exporting,
** the principal.

In entry and exit summary declarations, the EORI numbers of the following persons must be quoted:
** the carrier (in ATLAS-EAS: mover) on entry,
** the person who lodges the summary notification (person responsible) and/or the authorised declaration agent,
** the consignee on entry (if known),
** the consignor/exporter on exit (if known).

The EORI number functions as an identification and/or administrative code under which the address details of the operator, and where applicable, the approvals granted to him by the customs administration, as well as the network links to which he has access are filed (within the provisions of data protection legislation).

The EORI number must also be quoted in the framework of approval procedures conducted by the Federal Office of Economics and Export Control and/or the Federal Agency for Agriculture and Food. It is also required for recording the import turnover tax payable to the tax office as assessed via the paperless ATLAS IT procedure.

Requesting an EORI number and amending an operator’s particulars:
Request procedure:
EORI numbers are assigned on request free of charge by the Customs Information and Knowledge Management (Informations- und Wissensmanagement Zoll).

The request must be lodged using form 0870 (Beteiligte – Stammdaten EORI-Nummer). It must include a legally-binding signature and be sent together with the required documents by e-mail (as pdf-document), by post or by fax to the Information and Knowledge Management section of the German customs administration. The form is also available in English (0870en – Participant master data EORI-number).

Pages 1 and 2 (fields 1 to 41) comprise the request as such. Instructions on completing the form are found on pages 3 and 4.

As far as the accompanying documents are concerned, the notes on the back of the form should be observed, which require e.g. that the request be accompanied with an extract from the commercial register or the business registration.

In principle, only fully completed forms may be returned; however, should certain particulars still be unknown (for example, the value added tax identification number) the incomplete request can still be processed, but the missing particulars must be submitted later.

If the request is being lodged by a representative on the behalf of the operator, it must either be accompanied with evidence of proper authorisation of the person being represented, or such authorisation must be clearly indicated in the request.

The request must be accompanied by the representative’s complete contact details.

In due course the Information and Knowledge Management will inform the representative of the assignment of the EORI number.

A request for an EORI number should be lodged as timeously as possible prior to initiating the activities that are governed by customs law.

The EORI master data (which correspond with the ATLAS master data) will be transmitted to the European Union pursuant to Annex 38 d of Regulation (EEC) No 2454/93 so that they can be accessed there by the authorities of other European member states.

In addition, a facility will be established on the Internet to allow the validity of EORI numbers to be confirmed. Provided that the (additional) consent allowing third parties access to the data is granted, the name and address of the economic operator will also be accessible.

The transmission of the data to the European Union and the establishment of an Internet research facility require, under German data protection legislation, that German economic operators have expressed their written consent.

If the economic operator does not grant his consent to the transmission of his data to the European Union, an EORI number cannot be assigned. Witholding consent to the publication of the data in the Internet on the other hand has no consequences under customs law.

Amendment procedure:
Customs information and knowledge management must be informed of all master data amendments (such as renaming of companies, changes of activities, changes of address) using a signed form 0870. Use of this form is obligatory as the data are processed electronically. The amendment application must be accompanied with a current extract from the commercial register or a current business registration.

Notification of the closing of a business must also be given on form 0870. The operator’s EORI number will subsequently be deleted.
