NCPE Complaints Submission Procedure :

Complaints:
Anyone who believes that s/he has been a victim of discrimination on the basis of sex or family responsibilities, sexual orientation, age, religion or belief, racial or ethnic origin, and gender identity in employment, banks and financial institutions as well as education and discrimination on the basis of racial or ethnic origin and gender in the provision of goods and services and their supply may submit a complaint to NCPE.

Submitting a Complaint:
Anyone who believes that s/he has been a victim of discrimination on the basis of sex or family responsibilities, sexual orientation, age, religion or belief, racial or ethnic origin, and gender identity in employment, banks and financial institutions as well as education and discrimination on the basis of racial or ethnic origin and gender in the provision of goods and services and their supply, may submit a complaint to NCPE by downloading and filling in the form

Complaints Procedure :
The Commissioner may initiate investigations on:
(i) any matter involving an act or omission that is allegedly unlawful;
(ii) the receipt of a complaint in writing by persons who claim to be the victims of discrimination.

Each case presented for investigation is managed with confidentiality.

The National Commission for the Promotion of Equality (NCPE) can only act upon complaints made in writing.

To lodge a complaint with regards to sex or family responsibilities, sexual orientation, age, religion or belief, racial or ethnic origin, and gender identity one may:
1. download the Complaints Form. Once compiled, the form must be signed and returned to NCPE;
2. call / email NCPE (+356 2590 3850 / equality@gov.mt) to set an appointment with the Complaints Section.

Persons who wish to make a complaint but require assistance to formulate / write the complaint, will be assisted by NCPE.

Forms are either in Maltese or English.

Every complaint is acknowledged in writing.

NCPE’s Complaints Sub-Committee regularly meets to discuss complaints received and writes to the parties against whom the complaint was made, informing them of the allegations made and asking for their version of the facts (report within 10 working days).

To help the investigations, face to face interviews may also be carried out.

The Commissioner may also summon both parties and mediate to find an acceptable solution to all involved, subject to consent from both parties.

NCPE endeavours to ensure that each complaint is dealt with in the least possible timeframes.

After the investigation, the Commissioner may:
a) dismiss the complaint;

b) find that the complaint is proved and thereupon, may:
(i) where the action complained of constitutes an offence, make a report to the Commissioner of Police for action on his part; or

(ii) where the action complained of does not constitute an offence, call upon the person against whom the complaint is directed to redress the situation, and mediate between the complainant and such person to settle the matter.

c) The Commission may itself refer the matter to the competent civil court or to the Industrial Tribunal for redress.
