Issuing Temporary Passport

The ordinary temporary passport is issued to Romanian citizens who comply with the conditions provided by the law and do not fall under the incidence of the cases of when the right to travel abroad is suspended, within at most 3 working days, in the following situations

** for the persons who do not have the time necessary for issuing an ordinary electronic passport;
** in case the holder makes a written statement that he/she will travel in states that are in state of war or diplomatic conflict and he/she has included in the ordinary/electronic passport a visa issued by the state that is in conflict with the country where he/she wants to travel;
** when the holder has a passport containing valid visas but because all the visa pages are full, the travel to that state or to states other than those who issued the visas is no longer possible;


** when the holder has lodged his/her passport for obtaining visas and they must urgently travel abroad;
** when the child has to travel abroad for studies or for getting a medical treatment in the absence of which his/her life or health are in jeopardy and there is not enough time for obtaining the other parent’s consent;
** for Romanian citizens from abroad who no longer hold valid travel documents and who declare that they need to proceed with their travel abroad or have to render legal their stay on the territory of a state.

Note:
Fingerprints are not taken for the issuing of the temporary passport.

Lodging An Application For Issuing The Temporary Passport:
The applications for issuing temporary passports are lodged by the applicant in person, when in the country, at the public community services for passports issuing and records in the territorial range of which they hold their domicile or, as the case may be, their residence, and when abroad, at Romania’s diplomatic missions and consular offices (art. 17ˆ1 par. 4 corroborated with art. 15 par. 2 of the Law no. 248/2005).

In case when, for objective reasons, the applicant of the temporary passport cannot come to the public community service for passports issuing and records of his/her domicile or residence, the applications for issuing the ordinary electronic passports can be lodged with the nearest passports service(art. 17ˆ1 par. 4 corroborated with art. 15 par. 3 of the Law no. 248/2005).

Delay For Issuing The Temporary Passport:
The applications are solved by the competent authorities in delays that flow as from the date of their lodging; such delays cannot exceed 3 working days.

Note:
For applications lodged in Romania the delay of issuing the temporary passport is reduced to 2 hours.

Documents Necessary For Issuing The Temporary Passport:
A) In Case Of Adults With Domicile In Romani:
** the identity card, the temporary identity card or, as the case may be, the identity bulletin. Such documents must be valid and provided in original. The temporary identity card must be accompanied by the birth certificate, in original;
** the proof of passport fees and of the additional tax payment, in original;
** the prior passport, in original, if any.

Note:
the application is accompanied by two identical color photos of the holder with dimensions of 3.5 x 4.5 cm, in case of persons who temporary lack the capacity of exercise and who are not present upon the lodging of the application.

In Case Of Children Under The Age Of 14 With Domicile In Romania:
** the child’s birth certificate, in original;
** identity documents of both parents or of one parent, of the legal representative or, as the case may be, of the empowered person. All such documents must be valid and provided in original;
** the proof of passport fees and of the additional tax payment, in original;
** as the case may be, special power of attorney or the declaration of consent of the other parent in original, the definitive and irrevocable Court decision for the child’s custody, the definitive and irrevocable Court order which replaces the other parent’s consent or, for applications lodged by the surviving parent or by the person empowered by the same, the death certificate of the other parent, in original;
** documents issued by the institution that organizes the courses or the contest, documents issued or approved by a Romanian administrative authority competent in the field or, as the case may be, documents issued or endorsed by a Romanian medical authority, evidencing the period of time and the state or states where the courses will be kept, the contests will take place or the medical treatment will be carried out, solely for the applications lodged by the parent mentioned by the art. 7 par. 1 lett. e) of the Government Decision no. 94/2006 for the approval of the Methodological norms for enforcement of the Law no. 248/2005, as subsequently amended and supplemented, or for the applications lodged by the person empowered by this parent, under the art. 7 par. 1 lett. h) of the same enactment, in original;
** the child’s prior passport, if any.

Note:
** the documents are lodged by the parents/parent/legal representative/empowered person;
** the application is accompanied by two identical color photos of the child with dimensions of 3.5 x 4.5 cm, only in case the child is not present upon the lodging of the application.

C) In Case Of Children Between The Age Of 14 And 18 With Domicile In Romania.
** the child’s identity card or, as the case may be, the temporary identity card, valid documents in original. The temporary identity card as well as the new identity card (which does not include the parent’s first names) must be accompanied by the birth certificate in original;
** declarations of consent of the parents/parent/legal representative (for underage persons who are legally married such declarations are no longer necessary); in case only one parent’s consent is provided, the application must be accompanied by: a) Court decision granting the child’s custody or replacing the other parent’s consent, both being definitive and irrevocable, b) the other parent’s death certificate or c) documents issued by the institution that organizes the courses or the contest, documents issued or approved by a Romanian administrative authority competent in the field or, as the case may be, documents issued or endorsed by a Romanian medical authority, evidencing the period of time and the state or states where the courses will be kept, the contests will take place or the medical treatment will be carried out, in original;
** the proof of passport fees and of the additional tax payment, in original;
** the child’s prior passport, if any.

Note:
** declarations of consent for the child’s passport issuing are given in front of the passports officer who is taking over the application, case when the identity documents of both parents, of one parent or of the legal representative, in original, must be provided;
** declarations pertaining to the consent for issuing a child’s passport given in different conditions than those provided above must be authenticated, when in the country by the public notary, and abroad by Romania’s diplomatic missions or consular offices or by the foreign authorities, case when the provisions of the art. 9 par. 7 of the Government Decision no. 94/2006 for the approval of the Methodological norms for enforcing the Law no. 248/2005, as subsequently amended and supplemented, must be enforced;
** Court decisions given abroad must fulfill the conditions provided by the law for being recognized and enforced.
** the application is accompanied by two identical color photos of the holder with dimensions of 3.5 x 4.5 cm, in case of persons who temporary lack the capacity of exercise and who are not present upon the lodging of the application.

Collecting The Temporary Passport:
This travel document is collected from the public community service or, as the case may be, from Romania’s diplomatic missions and consular offices abroad by the holder personally, by the person who filed the application or by the person empowered by special power of attorney complying with the conditions provided by the art. 9 of the Government Decision no. 94/2006, as subsequently amended and supplemented.
