Employment Injury Scheme

This scheme provides coverage and protection for employees who suffers from employment injury.

“Employment Injury” means a personal injury to an employee caused by accident or an occupational disease arising out of an in the course of his employment in an industry to which this Act applies .

Coverage:
The protection under this scheme covers the following accidents:-
i. Industrial accidents while carrying out their duties

ii. Accidents while travelling :-
** On a route between his place of residence or stay and his place of work
** On a journey made for any reason which is directly connected to his employment
** On a journey between his place of work and the place where he takes his meal during any authorized recess

Note:
An accident that occurs during any interruption or deviation shall not be deemed to arise out of and in the course of his employment.

iii. Accident during emergency:
An accident happening to an employee while he is in or near any premises at which he is being employed and it occurs while assisting, rescuing or protecting other people from disaster or danger during an emergency.

Example : Fire disaster at employer’s premise

Reporting Of Accident:
Accident or Occupational Disease Reports should be lodged with the following documents:
** Accident Report (Form 21) or Occupational Disease Report – PKS(P) 68 (if still working) or Occupational Disease Notice – PKS(P) 69 (if resigned)
** Photocopy of Identification Card

** Photocopy of Attendance Record / Punch Card for the month of accident that is verified by the employer or a confirmation letter by the employer in the absence of Attendance Record or Punch Card
** For commuting accidents or outside of the employer’s premises

Original Police Report:
Sketch of map (that shows starting point, travel route, place of accident and destination)

When To Report The Accident?:
Employers shall submit the claim form and other relevant documents to SOCSO within 48 hours upon notification of the accident that have occurred to an employee.

** Medical Benefit
** Temporary Disablement Benefit
** Permanent Disablement Benefit
** Constant-attendance Allowance
** Facilities for Physical and Vocational Rehabilitation
** Return To Work Programme
** Dependants’ Benefit
** Funeral Benefit
** Education Benefit

Invalidity Scheme Benefits :
1) Invalidity Pension :
** Invalidity is defined as permanent morbid condition that are unlikely to be cured that result in an employee losing at least 1/3 of his or her capability compared to a normal individual, which ultimately causes a loss of income for the employee.

2) Invalidity Grant  :
** Invalidity Grant is payable to the eligible insured persons who have been certified invalid by the Medical Board or Appellate Medical Board but not eligible for invalidity pension due to failure to complete any qualifying conditions.

3) Constance-Attendance Allowance :
** This allowance is paid to an employee who is suffering from invalidity and is so severely incapacitated as to constantly require the personal attendance of another person, certified by Medical Board or Special Medical Board or the Appellate Medical Board.

4) Survivors’ Pension :
** Survivors’ Pension is payable to the eligible dependants of an insured person who dies irrespective of the cause of death not related to employment.

5) Funeral Benefit :
** Funeral Benefit will be paid to the eligible person as prescribed in the Act, if the employee dies due to any cause. In the absence of such person, the benefit will be paid to the person who actually incurs the expenditure.
