Obtaining Luxembourg Nationality :
As a result of the Law of 23 October 2008 on Luxembourg nationality, the Grand Duchy of Luxembourg now has a new legislation concerning nationality. The new Law entered into force on 1 January 2009.

Under the new Law on Luxembourg nationality, there are two ways of possessing or acquiring Luxembourg nationality:
possession of Luxembourg nationality by origin;
acquisition of Luxembourg nationality by naturalisation.
The new Law removes the possibility of acquiring Luxembourg nationality by the exercise of an option.
It introduced the principle of dual or indeed multiple nationality. Any person wishing to acquire Luxembourg nationality is no longer required to renounce to his nationality of origin, provided that the law in force in his country of origin allows this.
The acquisition of Luxembourg nationality implies accepting rights and obligations.

The Ministry of Justice has made publicly available various sources of information about the new legal provisions regarding Luxembourg nationality:
** a publication entitled “The Luxembourg nationality”. Law of 23 October 2008
** an on-line dossier
** A ‘Nationality Infoline’ has been set up;
** guichet.lu, the administrative guide of the Luxembourg state, explains the administrative procedures concerning the acquisition or recovery of Luxembourg nationality.
How can you obtain Luxembourg nationality by naturalisation?:
The main conditions for obtaining Luxembourg nationality are:
having reached 18 years of age; minimum period of residence of 7 years; a Luxembourg language test for people who have not completed 7 years’ schooling in the Luxembourg education system; compulsory attendance at a citizenship course.
Staying and/or working in Luxembourg for less than 90 days as an EU citizen :
** All EU citizens, as well as members of their family (who are also EU citizens), enjoy freedom of movement within the EU, giving them the right to work and reside in any EU Member State.
Who is concerned :
** “EU citizens” are nationals of an EU Member State, namely: Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, the Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden and the United Kingdom.
** Nationals of the other Contracting Parties of the European Economic Area Agreement (Norway, Iceland and Liechtenstein) and the Swiss Confederation are treated as EU citizens.
The following are considered “family members” :
** the spouse;
** the registered partner;
** the direct descendants (sons or daughters) of the EU citizen or their spouse/partner if the child is under 21 or is under their care;
** the direct ascendants (father or mother) if they are under the care of the EU citizen or their spouse/partner;
any other family member if :
** in their country of origin, they were under the care or were a member of the household of the EU citizen with the right to reside; or
** the EU national is obliged to personally take care of the family member in question due to serious health problems;
** the non-registered partner (free union) with whom the EU citizen has a duly demonstrated long-term relationship. These partners cannot be linked to another person through marriage, declared partnership or long-term relationship.
