Star Gold Humshakal Contest :

** These terms and conditions (“Terms”) set forth the terms of the agreement between Star India Private Limited (“STAR”) and each contestant/participant (“Participant” and/or “You/Your”) in North America, Canada, United Kingdom, Ireland, France, Netherlands, Portugal, Denmark, Switzerland, Germany, Norway, United Arab Emirates, Kingdom of Saudi Arabia, Oman, Qatar, Lebanon, Bahrain, Egypt, Jordan, Kuwait, Palestine, Syria, Yemen, Hongkong, Japan, Papua New Guinea, Thailand, Phillipines, Australia, New Zealand, Fiji, Kenya, Uganda, Tanzania, Bangladesh, Sri Lanka and Singapore (collectively “Territory”) who participates in the contest (“Contest”).

Participants must have attained the age of majority in their respective Territory of legal residence at the time of entry in the Contest

** Your act of participating in the Contest shall be deemed to be your absolute agreement to the Rules and Regulations, Terms, Privacy Policy and User Generated Content of STAR, as prescribed from time to time (hereinafter collectively referred to as “Terms and Conditions”). If you do not agree to be bound or cannot comply with any of the Terms and Conditions, please do not continue. Your failure to accept these Terms and Conditions will disqualify your participation in the Contest.
** The Contest shall be governed by the Terms and Conditions, and, by entering the Contest, each Participant acknowledges that he/she has read and understood, and unconditionally agrees to comply with and abide by these Terms and Conditions. The decisions of STAR on all matters relating to the Contest shall be final and binding in all respects.
** The Privacy Policy available on our Website shall govern all usage of any personal information and/or any other information as detailed in the Privacy Policy, including but not limited to, any information in relation to your participation in the Contest, gathered under, or pursuant to this Contest by STAR (if any).
** The Contest shall commence on 16th June, 2014 and shall conclude on 22nd June, 2014 on the Website. (“Contest Period”).

Participants Eligibility :
To participate in the Contest the Participant(s) must comply with the below :
The Contest is open to the viewers who have subscribed to the channel Star Gold UK, Star India Gold and Star Gold International (“Channels” as maybe specifically applicable to the country in the Territory) in the Territory;
Participant must be a subscriber of the Star available in his/her Territory;
Participant(s) must be legal residents of the Territory at the time of entry in the Contest;
The Contest is not open to the employees (permanent or contract) and directors, including each of their immediate family members, of (i) STAR, its parent, subsidiary and affiliated companies (collectively, “STAR Entities”); and (ii) advertising and promotion agencies, the distributors, suppliers of prizes, including each of their parent, subsidiary and affiliated companies and or entities connected with the promotion of the Contest (collectively, “Sponsors”); and
STAR reserves the right to verify the eligibility of all Participants.

Participation Mechanism :

1. To enter the Contest, the Participant has to watch the movies from Monday to Sunday at 8pm everyday from 16th June, 2014 to 22nd June, 2014 on the Channels and follow the instructions mentioned during the movies.
2. The movies during the time period mentioned above will feature the multiple choice questions relating to the Contest (“Contest Question”). The Participant will then have to log onto the following websites : (i) uk.startv.com – for UK and Europe region; (ii) https://www.startv.com/ – for North America and Canada viewers; and (iii) https://startselect.com/gb-en – for Middle East and South East Asia viewers.
3. Correct answers to the Contest Questions would give the Participant a chance to be declared as a Winner of the Contest and to receive a Prize.
4. Each Contest will run for a period of one (1) week during which the movies will be aired on the Channels on which the Contest Questions are featured (“Contest Period”).
5. The Participant will also have to furnish his/her subscription details such as name of platform/local cable operator for subscription to the Channels, subscription number/customer ID etc. and personal information such as name, address and contact information.
6. All the information entered on the Website by the Participant will henceforth be collectively referred to as “Submission”.
7. Any details submitted must be accurate and complete and are subject to proof upon request by STAR.
8. Entries received before the commencement or after the expiration of the Contest Period shall be void. Any incomplete and/or illegible entries will result in disqualification from entry into the Contest and the receipt of any prize.
9. STAR shall not be responsible for any entries submitted but not received or recorded due to any reason whatsoever. Without limiting the generality of the foregoing, STAR shall not be responsible for technical errors of any nature whatsoever that results in a Submission not being received. For purposes of the Terms, “receipt” of an entry occurs when the Website server records the entry information upon the Participant clicking the “Submit” button. Any automated receipt of confirmation does not constitute proof of actual receipt.
10. Only eligible Submissions received during the Contest Period will be included in the Contest.
11. Submissions should state all the required information asked from the Participant(s) at the Website. If the same is not complied with, then the Submission will not be considered and will be disqualified.

Selection Process and Prizes :
1. STAR shall at its sole discretion within seven (7) days after the expiry of the Contest Period select atleast 4 (one) Participants from the Territory (which shall be 1 Participant each from North America and Canada region, United Kingdom and Europe region, United Arab Emirates and MENA region, and Singapore) from amongst all completed Submissions received which answer the Contest Questions correctly (collectively “Winners”, singularly “Winner”). All the Winners shall receive merchandise from the movie “Humshakals” (collectively the “Prize”). For details of the Prize please refer to the section titled “Gratification” below.
2. The selected Winners will be intimated via the telephone number entered on the Website. STAR will attempt to contact the Participants twice on the number provided and if STAR is unable to successfully contact the selected Winners, a new Winner will be selected in that particular Winner(s) places.
3. STAR shall not be responsible if the Winners are not available at the telephone number provided by them and as a result of which the Winner loses his/her chance to receive the Prize.
4. The Winners will have to confirm their willingness to accept the Prize on the telephone on being contacted by STAR. This has to be followed by a confirmation of the willingness to accept the Prize by e-mail to the e-mail id provided at the bottom of the page within twenty four (24) hours of being contacted.
5. The Winners should have attained the legal age of majority in his/her Territory. The Winners must provide his/her full subscription details with the respective platform for verification purposes.
6. If the selected Winners are unable to or does not claim the Prize for any reason whatsoever, they shall be deemed to have withdrawn from the Contest and forfeited their right to claim the Prize.
7. All decisions of STAR shall be final and binding and shall not be subject to any appeal of any nature whatsoever. Entry in the Contest shall be construed that the Participant has waived their right to dispute any decision(s) made by STAR.
8. STAR reserves the right to withdraw the Prize(s) should the selected Winner(s) fail to comply with any of these Terms and/or applicable laws or for any reason whatsoever.
9. STAR, STAR Entities and the Sponsors assume no responsibility and shall not be held liable for any damages, losses, injuries, inconvenience or any other liabilities of any nature whatsoever arising in connection with the fulfilment of any Prize, nor for any changes in dates or times or cancellations which may prevent the selected Winners from availing of the Prize offered.
10. Each Participant hereby acknowledges and agrees that STAR or STAR Entities shall not be held responsible for any acts or omissions on the part of the distributors while availing of the subscription of the channels. It is solely the responsibility and discretion of the distributors in their respective Territory to distribute the channels to a particular Participant in any manner which they deem fit.

Gratification :
The Winners of the Contest shall be provided with movie merchandise from the movie “Humshakals”.

Additional Terms :
1. STAR reserves the rights to terminate or temporarily suspend the Contest at any time, with or without notice, for any reason whatsoever.
2. Under no circumstances will STAR, STAR Entities and/or the Sponsors be liable for any consequential, indirect, special, punitive, or incidental damages or lost profits, whether direct or indirect, arising in any way whether in contract, tort (including negligence) or otherwise.
3. The Winners hereby acknowledge and agree that the relationship between the Winners and STAR is not a confidential, fiduciary, or other special relationship.
4. The Winners hereby agree to be bound by the Terms and/or by any subsequent revisions of the Terms (“Revised Terms”). STAR reserves the right to amend, add or delete any of the Terms at its sole and absolute discretion without further notice. The Revised Terms (if any) shall supersede all prior Terms.
5. All Submissions shall become the property of STAR and/or STAR Entities. By entering the Contest, the Winners grant STAR and STAR Entities unlimited use of their names, address, voice, photographs, statements and/or likeness in any and all media without remuneration throughout the world in perpetuity for the purpose of publicity and/or advertising.
6. All ancillary costs associated with the receipt or use of the Prize, whether direct and/or indirect, including without limitation charges (including visa charges), expenses, taxes (including airport taxes), costs, etc, is the sole responsibility of the selected Winners.
7. By providing any personal information to STAR and/or entering the Contest, each Participant thereby waives their privacy rights and/or any privacy expectations they have with respect to the use of their likeness or personal information furnished to STAR. If a Participant does not wish to have his/her information and/or likeness viewed by or disclosed to others, he/she should not enter the Contest.
8. By entering the Contest, each Participant expressly agrees that their personal data supplied may be used by STAR and/or STAR Entities for the purposes of marketing the products and/or services of STAR and/or STAR Entities and that certain offers and information on such products and/or services may be sent to the Participant from time to time.
9. If any part of the Terms herein is held invalid or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the validity or enforceability of the remainder of the Terms and any such invalid term shall be deemed severed from the remainder of the Terms.
10. The Participants/Winners of the Contest agree that they shall hold harmless STAR, its affiliates, its directors, employees, officers, representatives and affiliates, subsidiaries, assignees, representatives in connection with the Contest and shall also not file in person/through any family member and/or any third party any applications, criminal and/or civil proceedings in any courts or forum against STAR to claim any damages or reliefs.
11. The Contest shall be governed by and construed in accordance with the applicable laws of England and Wales. All matters with respect to the Contest are subject to the exclusive jurisdiction of the Courts at London, England and Wales only.
