Filing Trade Mark Online :

IP Online Portal provides filing of new Trademark application, which consists of TM1 to TM31 forms. Other related & supporting documents can be uploaded as attachments during the filing process.

Preparation before getting started :
** Prepare all documents in digital format (GIF, TIFF, PDF or DOC).
** Please ensure that your Trademark representation is in GIF format with a size of not more than 100KB and 120×90 pixels.

** If you are an agent, please prepare your TM1 form to be uploaded to IP Online Portal.
** Prepare your Statutory Declaration in scanned format e.g. TIFF or PDF.

** Prepare your long List of Goods in a DOC file to be uploaded to IP Online Portal.
** Get your own Digital ID from MyIPO

** Install your digital ID into your PC or save it in your secondary storage device e.g. thumb drive
** Digital ID must be attached to your application.

** Proceed with the payment. Check the fees in Pricing Scheme table.
** Print a copy of TM5 form before you make the payment.
** Print your Confirmation page upon successful filing.

Classification Of Goods And Services :
** The applicant is not encouraged to list or claim the entire class heading of each class of goods or services in the application form .

** Class headings only serve as general indications of the type of goods or services and may not cover all the goods or services in the class. You should itemize the specification of goods or services of your interest in the application.”

How do trademark applicants benefit from consulting MGS before filing an international application?
MGS helps trademark applicants ensure their applications meet the requirements of the Madrid System. In using the terms proposed in MGS trademark applicants can select terms to identify their goods or services in the knowledge that they will be accepted by the IB in the context of the Madrid System procedures.

** This will help to reduce the number of irregularity notices issued by the IB to applicants under Rules 12 and 13 of the Common Regulations under the Madrid Agreement and Protocol.

** Under Rule 12 (Irregularities with Respect to the Classification of Goods and Services), the IB shall notify an irregularity whenever it considers that the names of the goods and services for which the international registration is sought are not grouped in the appropriate classes of the International Classification.

** Under Rule 13 (Irregularities with Respect to the Indication of Goods and Services), the IB shall notify an irregularity whenever it considers that any of the goods or services in an international application is indicated by a term that is too vague for the purposes of classification or is incomprehensible or is linguistically incorrect.

About Us :
Prior to 1983, intellectual property rights (IPR) in Malaysia was administered by Pejabat Cap Dagangan dan Jaminhak. This Office changed its name to Pejabat Cap Dagangan dan Paten in 1983 and was placed under the jurisdiction of the then Ministry of Trade and Industry.

On 27 October 1990, the Ministry was restructured and the Office was placed under the Ministry of Domestic Trade and Consumer Affairs which is now known as Ministry of Domestic Trade, Co-operative and Consumerism and changed its name to Intellectual Property Division. The Division was tasked to administer Patents Act 1983, Trade Marks Act 1976, and Copyright Act 1987.

The Industrial Designs Act 1996 came into force in 1999, followed by the Layout-Designs of Integrated Circuits Act 2000. In 2001, the Geographical Indications Act 2000 came into force.
