Registration Guidelines For Upstream Petroleum Companies :
All upstream petroleum companies who intend to operate in Ghana are required to register with the Petroleum Commission and be issued with a permit (renewable annually) before commencement of operations. Below is the process :

A. Acquisition Of Application Pack :
An application pack must be obtained from Petroleum Commission for a non-refundable fee of One Hundred Ghana Cedis (GH- 100) payable by Banker’s Draft ONLY to Petroleum Commission Ghana.
B. Submission Of Application Form And Related Documents :
Application for registration MUST be submitted with the following documents:
** Cover Letter – Applicant
** Certificate of Incorporation – Registrar General’s Dept.
** Certificate to Commence Business – Registrar General’s Dept.
** Company Regulations (Company Code) – Registrar General’s Dept.
** Letter from Registrar General with Form 20 & 21 attached – Registrar General’s Dept.
** Audited Financial Reports – Applicant
** Valid SSNIT Clearance Certificate – SSNIT
** Business Plan – Applicant
** Company Profile – Applicant
** Copy of Application pack receipts – Applicant
Note :
(i) Financial statements must be audited by a recognized auditing firm.
(ii) If an applicant cannot submit any of the documents listed above, the applicant will have to obtain a waiver from the appropriate Government agency.
(iii) The Petroleum Commission works closely with all Government agencies to ensure strict compliance with all statutory regulations.
C. Assessment And Evaluation Of Application :
The Commission would review all applications and where necessary, may carry out site/facility inspections.
The outcome of the review could be any of the following :
(i) Application rejected
(ii) Additional information required
(iii) Application Approved
Successful applicants would be required to pay appropriate fees based on their Annual Turnover (for already existing companies) or Projected Revenue (for newly formed companies).
D. Issuance Of Permit :
(i) Permits would only be issued by the Petroleum Commission after the applicant has satisfactorily met all requirements and paid the appropriate fee.
(ii) Permits would be ready for collection five (5) working days after the appropriate fees have been paid.
(iii) Permits can be picked up by an authorized representative with either a valid company or National ID (Driver’s license, Voter’s ID or Passport).
Note :
(i) All communications to the Petroleum Commission MUST be on the company’s official letterhead.
(ii) Application for the registration MUST be made by the corporate head of the company or an authorized representative.
(iii) All applicants (companies) are restricted to one category of service. Applicants may then select at most two activities under a particular category in accordance with the Commission’s Classification of Upstream Petroleum Industry Activities.
(iv) Companies or individuals failing to satisfy the Commission’s registration requirements will have their application rejected.
For external companies :
** If applicant is a newly incorporated company, applicant would have to submit a 3-year financial projection as part of its business plan.
** If applicant is exempted from paying VAT/Tax, the applicant would have to obtain a letter from the Ghana Revenue Authority or the VAT Service confirming its exemption.
