Please note that you cannot apply for a residence and work permit under the fast-track scheme until April 1st 2015.

The fast-track scheme makes it easier for certified companies to bring employees with special skills or qualifications to Denmark.

Quick job start:
The fast-track scheme gives certified companies the possibility to hire highly qualified foreign nationals on short notice without having to wait for an application to be processed by the Danish Agency for Labour Market and Recruitment. At the same time, the scheme offers the possibility that the foreign national can work alternately in Denmark and abroad.

The fast-track scheme means that a foreign employee under certain circumstances can begin working in Denmark immediately after he or she has submitted an application for a residence and work permit.

The four tracks of the scheme:
The fast-track scheme is divided into four tracks. As such the scheme can be utilised by a foreign national who has been offered a job by a certified company and the job offered meets one of the following criteria:

1) The foreign national is employed according to the conditions in the Pay Limit scheme

2) The foreign national is employed as a researcher
Please note that guest researchers and PhD students are not included in the Fast-track scheme.

3) The purpose of the employment is a high level educational stay
Highly qualified foreign nationals with significant professional experience within a particular field of work can be included in the Fast-track scheme if the purpose of the stay in Denmark is to receive highly qualified training within the certified company, or to train, at a highly qualified level, other employees of the certified company.

Trainees are therefore not included in a high level educational stay under the Fast-track scheme.

4) The employment is for a short stay of maximum 3 months
The Fast-track scheme gives the possibility for foreign employees who are not exempt from the normal rules to reside in Denmark for up to 3 months without specific conditions being applied to the foreign national’s employment. However, the residence permit is conditional upon the salary and terms of employment corresponding to Danish standards.

The permit will not lapse during stays abroad:
When a foreign national is included in the Fast-track scheme, he or she can – within the validity period of the residence permit – alternately work in Denmark and abroad without the permit lapsing.

Normally a residence permit will automatically lapse if you give up your residence in Denmark or if you have resided outside of Denmark for longer than 6 months. To take up residence in Denmark again you must apply for a new permit. These regulations, however, do not apply to residence permits under the Fast-track scheme.

Conditions for using quick job start:
If you wish to make use of the Fast-track scheme’s possibility for quick job start, as a foreign national you must arrange legal entry into Denmark by yourself. Before you start working, you must appear in person at the Danish Agency for Labour Market and Recruitment and be subjected to a number of checks, including an identity check, a check that you have not been registered as undesirable in the Schengen region and a check that you have entered a contract with a certified company. In addition, we will check that you have paid the processing fee and you must have your biometric features recorded.

If you fulfil all the conditions, you will be granted a temporary permit allowing you to start working. The permit is valid until a decision has been reached regarding your application for a residence and work permit.

If you do not wish to enter Denmark before a residence and work permit has been granted, you are still able to apply for a residence permit under the Fast-track scheme from your home country and await the decision from the Danish Agency for Labour Market and Recruitment. In this case you will not take advantage of the Fast-track scheme’s possibility for a quick job start, but you will still be exempt from the regulations concerning the lapse of a residence permit.

Duration:

A residence permit under the Fast-track scheme is granted for a period of up to 4 years, unless the application concerns a short stay of up to 3 months. In this case a residence permit can be granted for a maximum of 3 months within one year.

The permit for a short stay cannot be extended and an application must be submitted for each short stay in Denmark.

A residence permit is granted in such a way that the permit will expire 14 days after the end date of the employment contract. However, the permit will not be granted for a period exceeding 4 years – or 3 months in case of a short stay.

If you are granted a residence and work permit based on an indefinite employment contract (that is, an employment contract with no expiration date), the duration of your permit will normally be 4 years. After this point, you can apply for an extension of your permit if you are still in the same job. If your permit expires, and you have applied for an extension, and you are still in the same job, on the same terms as when you got your original permit, then you can stay in Denmark and continue working while your application for an extension is being processed.

If you are granted a residence and work permit based on a temporary employment contract, the duration of your permit will be the same as that of your employment contract.

Please note that it is a precondition that your passport is valid for at least 3 months beyond the time period for which you seek a permit.

If your employment is terminated, your residence and work permit will normally be revoked.

If you change your job:
If you find a new job while you are working, you may begin your new job before you have received a new permit, provided that you submit an application for a new residence and work permit no later than the day you start your new job.
