Outdoor Display/Performance Application

1) Applications will be handled according to the Sun Moon Lake National Scenic Area display/performance application review announcement (first issued in 2008).

2) Persons that are issued a display/performance permit by the Sun Moon Lake National Scenic Area Administration (the “Administration”) may apply to the Administration before December 31, 2008, for a display/performance site.
(1) Applications can be faxed to: (049) 285-5593; or emailed to yichuan@sunmoonlake.gov.tw (please indicate “Display/Performance Application” as the subject). Applications can also be personally filled out and submitted at the Administration. The application period is from seven days prior to the performance/display date to 9:00 a.m. on the day of the display/performance.

(2) Registration by phone: Before beginning the display/performance, applicants should call the Administration at (049) 285-5668 to confirm the site of the display/performance. If the site is already rented or over-booked, or if the Administration so requires, the display/performance site may be changed.

(3) Displays/performances shall start and end within the time period specified on the application.

(4) Dispute resolution: If there is a dispute over the site or content of the display/performance, the displays/performances of involved parties shall maintain a suitable distance of separation or apply to the Administration for mediation. In such cases priority will be given to the first applicant and applicants that have registered.

3) The maximum numbers of simultaneous display/performance groups at any one site are as follows:
(1) Shueishe Wharf Plaza: 2 groups
(2) Hemei Garden: 3 groups
(3) Mingsheng Street: 3 groups
(4) Shueishe Visitor Center 2F Plaza: 4 groups
(5) Wunwu Temple Front Plaza: 4 groups
(6) Ita Thao Wharf Plaza: 4 groups
(7) Chaowu Wharf: 2 groups
(8) Lake-round Trail (Shueishe to Jioulongkou Section): 3 groups
(9) Checheng Teahouse: 1 group
(10)Checheng Logging Exhibition Hall: 2 groups

4) Applicants should follow the below regulations:
(1) The display/performance time is from 10:00 a.m. to 9:00 p.m. daily
(2) The permit issued by the Administration should be prominently shown at the display/performance site for inspection by Administration personnel.
(3) Applicants may accept payment in the forms of donations, awards or fixed price. All fees should be clearly marked at the performance site in advance.
(4) Display/performance content must be created or performed on site. Items not created on site may not be sold at the site and must be clearly marked “Not for Sale.”
(5) Displays/performances should be kept to within a suitable noise level, and noise level should be adjusted as directed by the Administration.
(6) Displays/performances should not violate public order or good social customs.
(7) Displays/performances should not obstruct pedestrian or vehicle traffic, facilities for the handicapped, building entries, fire safety facilities or obstruct transportation and safety in any other way.
(8) Applicants should keep the performance site clean and promptly return the site to its original sanitary state and remove all trash after the display/performance is completed.
(9) Applicants will be liable for the repair and cost of any damages caused by their display/performance to the site.
(10) Performances should not be religious or political in content.

5) The Administration may revoke a display/performance permit and order suspension of all or part the display/performance for any in any of the following circumstances:
(1) Regulatory changes
(2) Coordinating with policy needs
(3) Violation of public order or good social customs
(4) Activity content or products and services for sale not in accord with the items of the issued permit
(5) Transfer of a permit to another party for use
(6) Violation of laws or regulations

6) In the event of permit revocation for reasons listed in items three to six above, the involved party may not submit another display/performance application for a period of one year from the date of permit revocation.

7) The Administration reserves priority usage right for sites and facilities. If the Administration needs to use a site or facilities, it may notify display/performance applicants of delay or suspension of use of said site/facility. Applicants may not seek any compensation for losses in such cases.

8) The Administration may assess street displays/performances. The organizers of highly rated displays/performances will be given priority in participating in related activities held by the Administration and their permit period may be extended. The method of assessment will be separately specified by the Administration.
