Alien Resident Certificate (ARC):
Requirements of application for an alien resident certificate (ARC) upon entry via a visitor visa

I. Terms :
1. Articles 23, 24, 65, 70 and 71 of the Immigration Act (hereinafter the Act).
2. Articles 3, 6 and 9 of the Regulations Governing Visiting, Residence, Permanent Residence of Aliens.
II.Subject :
1. Upon one of the circumstances as follows, a foreigner upon entry via a valid visa unstamped No Extension or other restraints noted by the issuing agency with the validity of visit not less than 60 days may apply for residence to the NIA and hereby an ARC will be issued via permission. :
1.1 A foreigner whose spouse is a national residing in the Taiwan Areas with household registration or with granted residence, or who is granted residence or permanent residence. However, this does not apply to a foreigner whose foreign spouse granted residence is subject to the provisions prescribed in items 8-10 of paragraph 1 of article 46 of the Employment Services Act via permission from the central labor competent authority.
1.2 A foreigner not older than 20 years old whose elder lineal relative as a national residing in the Taiwan Areas with household registration or with granted residence, or who is granted residence or permanent residence. Where said relation occurs upon adoption, both the adopted and the adopter shall reside in the Taiwan Areas.
1.3 A foreigner engaged in the occupations prescribed in items 1-7 or item 11 of paragraph 1 of article 46 of the Employment Services Act via permission from the central labor competent authority or the competent authority in charge of the business.
1.4 Investors or representatives of foreign corporate investors permitted by or referred to the central competent authority in charge of the business with certain amount of investment in the R.O.C.
1.5 The responsible person of a foreign company in the R.O.C. licensed by the Company Act.
1.6 Upon diplomatic concerns, a resident visa is issued in the R.O.C. via ratification from the MOFA ad hoc.
2. The application of a 180-day visitor visa stamped No Extension is acceptable. However, this does not apply to those stamped No Resident Visa or No ARC in the Taiwan Areas.
III. Required documents :
(Any document made overseas and its Chinese translation shall be submitted altogether and be authenticated by an overseas mission. Where an overseas mission has authenticated only the former, the latter shall be notarized by the ROC court or notary.)
1. Application form :
1.1 The application form is available at respective NIA service centers or through download via the internet https://www.immigration.gov.tw/. A copy or a printed form in A4 size will do. Please fill out the form carefully.
1.2 One 2”x2” colorful photo within 1 year (vertical 4.5cm and horizontal 3.5cm, the size of the head shall be 3.2-3.6cm, background in white)
2. Passport and visitor visa (returned via verification)
3. A health certificate within 3 months :
3.1 This does not apply to the applicant in terms of items 3-6 of paragraph 1 of article 23 of the Act. A certificate of vaccination will do for children not older than 6 years. A health certificate will do where a certificate of vaccination is unavailable.
3.2 A health certificate shall follow the items required for a health certificate in the latest information with regard to residence for foreigners promulgated by the Department of Health under the Executive Yuan (DOHEY) (refer to the website of the Centers for Disease Control, DOHEY). The Items Required for Health Certificate (table B) promulgated by the DOHEY and employed by domestic major medical institutions shall apply to the checklist. (Refer to the appendix for a health checklist from January 1, 2009.)
3.3 A health certificate issued overseas shall be authenticated by an overseas mission. Items undone overseas but required by the DOHEY shall be done domestically.
3.4 A health certificate is valid for 3 months from the day of examination. The application shall be submitted within the prescription. (Please go to a domestic qualified medical institution after entry for health examination.)
3.5 In terms of items 1 and 2 of paragraph 1 of article 23 of the Act, if the applicant and the dependent related subject enjoy the same nationality and the relation exists prior to entry of the former, a health certificate of the former may be omitted where a health certificate of the latter is not required. On the other hand, if the applicant married to the dependent related subject after entry applies for residence of dependence, a health certificate of the applicant is required.
4. A certificate of criminal record :
4.1 This does not apply to the applicant in terms of items 3-6 of paragraph 1 of Article 23 of the Act and the applicant not older than 20 years old.
4.2 A certificate of criminal record in the R.O.C. within 3 months from the issued date (this does not apply to visitors for the first time).
4.3 A certificate of criminal record in the applicant’s state within one year from the issued date, but the validity noted on said certificate may not be overdue.
4.4 A certificate of criminal record shall cover the record within the latest 5 years.
4.5 In terms of item 1 of paragraph 1 of article 23 of the Act, if the applicant and the relative enjoy the same nationality and the relation exists prior to entry of the former, a certificate of criminal record of the former may be omitted where a certificate of criminal record of the latter is not required. On the other hand, if the applicant married to the relative after entry applies for residence of relations, a certificate of criminal record of the applicant is required.
4.6 Where the applicant with entry via a visitor visa applies for residence after exit not exceeding 3 months, a certificate of criminal record in the applicant’s state is not required.
5. A certificate of current residence
6. Certificate of cause (paragraph 1 of article 23 of the Act):
6.1 The application in terms of item 1: A certificate of marriage registered at the household registration office in the R.O.C., e.g. original of an R.O.C. ID card, a household certificate and a household certificate transcript (returned via verification).
Note:
Refer to the website of the Department of Household Registration, MOI or contact respective household registration offices with reference to marriage registration.
6.2 The application in terms of item 2:
a. Original of a household certificate transcript of the whole elder lineal relative’s household valid within 3 months or of an ARC (returned via verification).
b. Original of a household certificate transcript of the whole elder lineal relative’s household valid within 3 months or of an ARC (returned via verification).
6.3 The application in terms of item 3 :
a. Approval letter of employment for foreign professional approved by the Council of Labor Affairs (CLA) (The duration of employment written on the approval letter shall exceed 6 months.)
b. A certificate of incumbency valid within a month
c. A permit letter issued by the competent authority in charge of the business will do where the applicant is subject to those not required to apply for a permit of work to the CLA in terms of article 48 of the Employment Services Act.
6.4 The application in terms of item 4:
a. Approval letter of the Investment Commission, MOEA (the amount of investment shall exceed US$ 200,000).
b. List of Directors and Supervisors.
c. Company change registration form
6.5 The application in terms of item 5:
a. Approval letter of the Department of Commerce, MOEA
b. Recognition form of foreign companies
c. Registration form of branches of foreign companies
d. Certificate of profit-seeking enterprise
Where a manager of a branch of foreign company serves concurrently as the representative of the branch or the litigation and non-litigation agent, a permit of work issued by the CLA is required in addition to the preceding documents.
6.6 The application in terms of item 6: Approval letter from the competent authority is required:

NT$ 1,000 for an alien resident certificate (ARC) valid for one year. NT$ 2,200 extra for the applicant with entry via a visitor visa.

IV. Application :
1. The application is accepted at the local NIA service center.
2. The application to the NIA service center outside residence or the repeated application is not accepted.
V. Related terms:
1. The application in terms of item 1 of paragraph 1 of article 23 of the Act may be submitted 30 days prior to the due validity of visit.
2. The application in terms of items 2-5 of paragraph 1 of article 23 of the Act may be submitted 15 days prior to the due validity of visit.
3. The validity of an ARC is calculated from the approved date.
4. The applicant married to a national with household registration in the Taiwan Areas applying for residence of relations for the first time is subject to an ARC valid for one year.
5. The provisions prescribed by the Requirements may apply to required documents submitted by the applicant of residence cause change in terms of paragraph 2 of article 23 of the Act.
6. The applicant unable to acquire an ARC prior to the due validity of visit shall exit thereunder.
7. Where the applicant exits during the application, the case will be closed for filing (without review). Where the re-entry of the applicant meets any circumstances prescribed in respective items of paragraph 1 of article 23 of the Act, the application may be resubmitted in terms of the provisions prescribed in the Requirements.
