PIO Card Application :

Definition – In this scheme, unless the context otherwise requires: –
“Persons of Indian Origin” means a foreign citizen (not being a citizen of Pakistan, Bangladesh and other countries as may be specified by the Central Government from time to time) if,

** He/she at any time held an Indian passport; or
** He/she or either of his/her parents or grand parents or great grand parents was born in and permanently resident in India as defined in the Government of India Act, 1935 and other territories that became part of India. However, this will exclude any person who himself/herself or either of his/her parents or grand parents or great grand parents were at any time a citizen of Afghanistan, Iran, Bhutan, China, Nepal, Bangladesh, Pakistan and Sri Lanka.

** He/she is a spouse of a citizen of India or a person of Indian origin covered under (i) or (ii) above. However, if the spouse is holding passport of a SAARC country, China, Iran and Afghanistan, they are not eligible for grant of PIO.

An application for issue/renewal of a PIO card can be made in the prescribed form and accompanied by documentary evidence to show that the applicant is a person of Indian origin as defined. Only applicants having UAE residence visa can apply for PIO cards at CGI, Dubai.

Applicant needs to submit a proof that he/she or any of his/her parents or grand parents or great grand parents were of Indian origin as per the definition at (1) above. In case of establishing Indian origin of applicant through his/her parents, grand parents or great grand parents, linking documents which establish such links between applicant and his/her parents, grand parents or great grand parents have to be submitted.

Documents which can be submitted to prove applicant’s Indian origins for a PIO card include (please note that this list is not exhaustive) :
** Indian passport/ travel document of the applicant or either of his/her parents or grand parents or great grand parents.

** If the applicant is applying on the basis of his/her parents being Indian citizen, the ‘date of birth’ (DOB) certificate should invariably be one attested by the concerned authority. This concerned authority in India will include the home department of the concerned State as well as the Ministry of External Affairs of India at New Delhi.

For DOB certificates issued from other countries, these should be attested by the Foreign Ministry of the concerned country and/or Consulate/ Embassy of the concerned country in UAE and should submit this document in original after its attestaion.

Please note that any document attested only by Notary will not be accepted as a properly attested document. Some other documents which can prove residence/ nationality as an Indian include revenue records/ domicile certificates/ school/college leaving certificates etc. However, these will be considered only as supplementary proof of Indian origin of an applicant. Also, these should be attested by competent authorities as mentioned above.

** If the applicant was holding Indian passport he/she must bring the original passport after getting it cancelled. If the passport was surrendered, the original surrender certificate should be produced at the time of interview.

** In case of minors (below six years) the thumb impression of the child should be placed in the given signature box. Although the parents are required to sign in the application forms in case the applicant is minor, they should not sign in the box meant for their children/ applicant. In case of minors, PIO card is issued only for 5 years at a time.In case the applicant is minor, father and mother (Both Parents) should accompany the child. All relevant documents should be provided along with the application. Applicant should come individually and in the absence of the applicant, authorization letter should be provided. Original passport and receipt is mandatory to collect the card.

** In case PIO card is being applied for on the basis of spouse being an Indian citizen, the ‘Marriage Certificate’ should invariably be an attested one and spouse’s name must be endorsed on Indian passport. The attestation authorities will be same as mentioned in (a) above. The PIO card for such spouse can only be applied to after one year of marriage. Birth certificate copy should be provided.

** An applicant may claim to be a person of Indian origin on the basis of a domicile certificate issued from village officer /patwari of the place to which his parents belonged and should submit this document in original after its attestation by the First Class Magistrate of that place.

** Resident Visa page of the applicant and spouse’s passport copy is also mandatory even if spouse is not applying, as it is required for records’ sake.
** All documents should be self-attested by the applicant. In case of a minor applicant, the parents should attest the documents.

A PIO Card shall be valid for a period of fifteen years subject to the validity of the passport of the applicant.

PIO Card holders are entitled to following benefits: –
** Do not require a visa to visit India.
** Are exempted from the requirement of registration if their stay in India does not exceed 180 days. In the event of continuous stay in India, exceeding 180 days, they have to get themselves registered within 30 days of the expiry of 180 days with the concerned Foreigners Registration Officer at the District Headquarters.

** Enjoy parity with NRIs in respect of all facilities available to the later in the economic, financial and educational fields except in matters relating to the acquisition of agricultural/ plantation properties. No parity is allowed in the sphere of political rights .

Cancellation of PIO Card:
The Central Government may, by order, cancel the PIO Card, if it is satisfied that
:
** The PIO Card was obtained by means of fraud, false representation or concealment of any material fact; or
** The PIO Card holder has shown himself by act of speech to be disaffected towards the constitution of India and other laws of India; or

** The PIO Card holder is a citizen or subject of any country at war with, or committing external aggression against India; or of any other country assisting the country at war with, or committing such aggression against India; or

** The PIO Card holder has been sentenced in India for indulging in acts of terrorism, smuggling of narcotics, arms, ammunitions etc. or has been sentenced for committing an offense punishable with imprisonment up to one year or fine up to rupees ten thousand; or

** It is not conducive to the public interest that the person should continue to hold a PIO Card. No reasons shall be assigned for withdrawal of the Card.
** If any foreigner obtains a PIO card by virtue of being a spouse of an Indian national, and later on he/she divorces the Indian spouse, the Indian spouse must inform the authorities for the cancellation of PIO card.

** In the event of the loss of a PIO card, a duplicate card will be issued after charging a fees of AED 370/-, and subject to the completion of other formalities like lodging of police complaint regarding this loss. Please remember that a duplicate PIO card can only be issued from the same office that issued the original card.

Miscellaneous Services along with fee details:
For replacement of lost or damaged PIO Card, for endorsing the new passport number in the PIO Card on acquisition of new passport, for address change.

Fee AED 380.00 (cash) for lost or damage PIO Card (for lost PIO card, Police report & Lost PIO Card copy needed)

Fee AED 30.00 (cash) for the following services:
** Change of Passport Number (copies of new and old passports along with UAE residence visa page and PIO card would be required with original documents)
** Address change (copies of passport along with UAE residence visa, PIO card and New address proof would be required with original documents)

Instructions for filling-up PIO Card Applications:
** PIO application forms can be downloaded from the above link
** The forms need to be filled in duplicate and submitted in person at CGI, Dubai. In case where applicant is not a minor/infant, actual applicant is expected to submit the application himself. The applicants can come with all documents and forms between 9 a.m. to 11 a.m. to Room No. 105 in the Consulate to get the documents verified. Once this is done, the forms along with the fees can be deposited at the cash counter in front of Gate No. 2 till 1200 hrs only.
** All relevant documents substantiating claim as a person of Indian origin need to be enclosed in duplicate.
** A total of 6 (2+4) recent passport size photographs to be attached.
** A fee of AED 1160 (for adults) and AED 585 (for minors), is payable along with the PIO application.
** Applicant’s passport should also be submitted along with the application form.

Note:
Furnishing of false information will result in summary rejection of the application. Acceptance of application does not confer any right on the applicant to a PIO Card.
