Application For Gibraltarian Status

Guidance Notes:
Section 9 of the Act allows the Minister with responsibility for personal status, in his absolute discretion, to order the registrar to register a person as a Gibraltarian if that person is –

a) a British Overseas Territories citizen by virtue of his connection with Gibraltar, or Gibraltar or Great Britain is his country of origin;
b) a British national;
c) of good character;

d) has sufficient knowledge of the English language;
e) has his permanent home in Gibraltar;
f) has been resident in Gibraltar for periods amounting to not less than twenty five years in the aggregate including the whole of the period of ten years immediately preceding the date of application; and

g) intends to make his permanent home in Gibraltar

The burden of proving that you meet all of these conditions falls on you, as the applicant, and to help you do so you can produce the following documents –

For conditions (a) and (b):
You MUST bring us your passport.

You may also bring :
** Your birth certificate; and
** Your naturalisation certificate if you have been naturalised as a British Overseas Territories citizen by virtue of your connection with Gibraltar.

For condition (c):
You MUST bring us a certificate from the Royal Gibraltar Police showing that there are no convictions or police cautions recorded against you.
If you owe any arrears of Income Tax, rent, rates or any other debt to Her Majesty’s Government, you MUST bring evidence to show that you have made arrangements to repay this debt.

For condition (d):
This will normally be assessed when you submit your application at our counter. In some cases we may ask you to attend a formal evaluation with a professional assessor.

For condition (e):
If you live in your own home you MUST bring us the property deeds; or
If you live in rented accommodation you MUST bring us your rental agreement or a letter from your landlord.
In all cases you MUST bring us the last 3 months utility bills in your name.

For condition (f):
You MUST bring us a certificate from the Royal Gibraltar Police certifying the period that you have held a permit of residence.

We recommend that you also bring :
** Your identity card.
** A certificate of Social Insurance Contributions if you are working or have worked in Gibraltar.
** Rental agreements, property deeds or letters from landlords and utility bills throughout the period. If you have changed your address since you first arrived in Gibraltar it would be helpful if you provide evidence of each place where you have lived.
** Any other documents that will show that you have been living in Gibraltar (e.g. school, tax or medical records or testimonials from neighbours or other people who know you).

For condition (g):
You MUST state that it is your intention to make Gibraltar your permanent home and you will do this when signing the declaration in the application. You may also bring in a separate letter doing so.

Other helpful documents:
** A letter from your employer stating the period of your employment.
** If you are married and/or have any children you may also bring in your marriage certificate and birth certificates of your spouse and children.
