Granting of Identity Number :

For which individuals the legal status must be established? :
In case, if there is no information entered about an individual in the Population Register and identity number has not been granted to him or her, legal status of the individual in the state must be established.

In case, if legal status of the individual has not been established, he or she cannot receive a valid personal identification document, work legally, pay taxes, receive allowances or other services.

The Office of Citizenship and Migration Affairs establishes the belonging of individuals to:
The population of citizens of Latvia in accordance with Clauses 1, 11, 12, 13, 3, 4 and 5 of Section 2, Section 3 of the Citizenship Law ;
** The population of non-citizens of Latvia in accordance with the provisions of the Law On the Status of those Former U.S.S.R. Citizens who do not have the Citizenship of Latvia or that of any Other State;
** The population of stateless persons in accordance with the provisions of the Law on Stateless Persons.

What documents must be submitted for establishing the legal status and where? :
Documents for establishing the legal status may be submitted to any territorial division of the Office of Citizenship and Migration Affairs or to diplomatic or consular mission of the Republic of Latvia abroad, or by sending by postal mail to address: Ciekurkalna 1. linija 1, k-3, Riga, LV-1026, Latvia.

Who reviews the submitted documents and what is a period of review? :
Documents for establishing the legal status are reviewed by the Individuals’ Status Control Department of the Office of Citizenship and Migration Affairs.

A decision about granting or rejection of the legal status is made within the period provided for in Section 64of the Administrative Procedure Law, i.e., within one month from a day of receipt of the application. If necessary, review of the matter may be prolonged for up to four months.

In case of granting the legal status, identity number is granted to the individual and information is entered in the Population Register.

Citizenship Of Latvia:
If an individual wishes to obtain citizenship of Latvia, he or she must submit the following:
** An application with a request to grant citizenship of Latvia;
** Birth certificate or an excerpt from the Birth Register. If the individual was born abroad, his or her birth certificate must be translated into the official language and legalized in accordance with the procedure provided for in regulatory enactments;
** A personal identification document (if any);
** A document certifying the individual’s rights to obtain citizenship of Latvia;
** Curriculum vitae.

Establishing Of Legal Status And Granting Identity Number To A Child:
In case, if one of parents of a child who was born in Latvia is a citizen of another state, or if the child was born abroad, documents for establishing legal status must be submitted to any territorial division of the Office of Citizenship and Migration Affairs or diplomatic or consular mission of the Republic of Latvia abroad.

Documents required:
1. An application from parents with a request to grant specific legal status to their child (citizenship of Latvia, status of a non-citizen of Latvia, status of a stateless person);
1.1. If the child was born abroad, his or her parents shall confirm in their application that they have no objection to reproduction of the child’s given name and surname in the Latvian language. In case, if parents have objections to reproduction of the child’s given name and surname in the Latvian language, the parents must obtain a statement from the State Language Agency about reproduction of the child’s given name and surname in the Latvian language;
1.2. In case, if a child has reached the age of 15 years, he or she shall confirm in an application that he or she agrees with the request of the parents and shall sign the same;
2. A birth certificate of the child or an excerpt from the Birth Register. If the child was born abroad, his or her birth certificate must be translated into the official language and legalized in accordance with the procedure provided for in regulatory enactments;
3. Personal identification documents of parents;
4. A personal identification document of a minor (if any);
5. In case of granting citizenship of Latvia: agreement of the parents about granting citizenship of Latvia to their child, if, at the moment of birth of the child, one of the parents is a citizen of Latvia and the other parent is a foreigner and permanent place of residence of both parents is outside Latvia;
6. In case of establishing of the status of a non-citizen of Latvia: a statement issued by a foreign competent institution stated by the Office of Citizenship and Migration Affairs and certifying that the individual is not and has never been a citizen of the respective state, or documented confirmation that such a document could not be obtained.
7. In case of establishing of the status of a stateless person: a document issued by a foreign competent institution stated by the Office of Citizenship and Migration Affairs and certifying that the individual is not a citizen of the respective state and citizenship of such state is not guaranteed, or documented confirmation that such a document could not be obtained.
