Permanent Residence:

If you have lawfully lived in the Netherlands for an uninterrupted period of 5 years and you have a valid residence permit for a non-temporary purpose of stay, you can apply for a permanent residence permit. Certain conditions will have to be met in order to be eligible for permanent residence.

The permanent residence permit for long-term resident EC:
When you apply for permanent residence, your application first will be checked against the European requirements in accordance with Directive 2003/109/EC.

If your application meets these European conditions, a permanent residence permit for long-term resident EC will be granted in accordance with European legislation.

If your application does not meet the European conditions, the IND will then assess your application under national legislation. If these conditions have been met, a permanent residence permit will be granted in accordance with national legislation. If your application also fails to meet these conditions, the IND will assess whether you are eligible for an extension of your current residence status. You will only need to pay one fee for this possible double or triple assessment.

Obtaining information:
Before submitting your application, it is advisable to first find out whether you meet the conditions.

To find out more about the specific conditions, you can follow either of these options:
** Check our Residence Wizard.
** Call the IND at 088-0430430 (local call charges plus any additional costs charged by your operator when calling with your mobile phone).
** Go to a regional IND Information desk .

Conditions for permanent residence:
To be eligible for permanent residence, you will have to meet the following conditions:
** You have held a temporary residence permit for a minimum of 5 consecutive years.
** You currently have a residence permit for a non-temporary purpose of stay.
** You have sufficient and long-term means of support.
** You do not constitute a risk to public order or national security.
** You are sufficiently integrated in Dutch society and are able to read, write, speak and understand Dutch. You must prove this by taking a civic integration examination. If you successfully complete a civic integration course (at A2-level) or attain another diploma you will be eligible for an exemption.

Completing the form and gathering the documents:
The application form must be completed in full. You will need to gather certain documents and submit them together with your application.

When you apply for permanent residence, you need to submit the following documents:
** A copy of a valid travel document (for example a passport).
** Documentary proof of income.
** A civic integration examination diploma or a comparable diploma.

Depending on the situation, certain documents may need to be legalised and/or translated. All documents must be in Dutch, English, French or German. If this is not the case, please have the documents translated by a translator sworn by a court and submit both translation and document. If you do not have the document translated in the Netherlands by a translator who is sworn by a Dutch court, but abroad instead, the translation also has to be legalised.

Submitting your application and paying the fees:
The application for a permanent residence permit can only be done in writing by using the application form ‘aanvraag of wijziging verblijfsvergunning regulier voor onbepaalde tijd’ (only available in Dutch). When you have fully completed the form and gathered all the required documents, you can send the application form to the IND.

Once the IND has received your application, the CJIB (the Central Fine Collection Agency) will send a giro payment slip. This giro payment slip also serves as a confirmation that the IND has received your application. You must always pay the fees by using this giro payment slip. If you fail to do so, your application will not be processed. It is not possible to pay via other means or in instalments. Please note that you pay for processing your application, not for the residence permit itself. The fees will not be refunded if your application is rejected.

Assessment of the application:
The IND will assess your application for a permanent residence permit. This procedure may take some time. Fore more information on the statutory decision period, please check duration of procedures.

Response to your application:
You will receive either one of the following responses to your application:
1. Your application for permanent stay has been granted. You will receive a decision stating that permanent residency has been granted.
2. Your application for a permanent residence permit is refused. In this case, you will receive a decision which will explain why you have not been granted a residence permit. You can register an objection against this decision. The decision also explains how to do this.

If your application for permanent residence fails to meet the conditions, the IND will automatically assess whether you are eligible for an extension of your current temporary residence permit. In this case, no additional fees will be charged.

Collecting your residence document:
After the IND has granted permanent stay, the actual residence permit will be issued. This can take a couple of weeks after having received the decision. As soon as the document is ready, you will receive an invitation letter to come pick up your residence document at a regional IND desk. The invitation letter states what documents you need to bring with you.

On the residence document itself you will find your personal data, along with other information such as your V-number, your purpose of stay as well as the end date of your stay. On the residence document you will also see your employment status (arbeidsmarktaantekening). This status tells you whether and how you are allowed to work.

When you have permanent residence, you are free to work without the need for a work permit (TWV).

Upon collecting your residence document, make sure to check all (personal) data on the document. If they are, in any way, not correct, please do not take the document home with you, but notify the IND employee attending you at the IND desk.

The document for permanent residence is valid for 5 years. This means that it has to be renewed every 5 years.
